Many churches do not realize their legal documents need attention. Congregations are often using bylaws drafted in the 1950s or “off-the-shelf” templates never designed specifically for Churches of Christ. Others discover they lack proper corporate status—or worse, that they’ve lost it by not filing required reports.
“It troubles me that churches oftentimes do not operate with the same diligence that we as human beings do with our own affairs,” Mike says.“These are God’s assets that our Lord has entrusted to us.”
A church’s legal documents protect church members from personal liability. When a church incorporates and maintains its corporate status properly, members are shielded from claims or damages against the congregation. But this protection only works if churches keep their documents current and maintain corporate status requirements.
Proactive Legal Care for Every Stage of a Church’s Life
Heritage21’s legal services include reviewing and updating Articles of Incorporation and Bylaws, addressing deed restrictions that could inhibit property transactions, and helping churches obtain 501(c)(3) documentation when needed. “It’s important to evaluate legal documents when churches are healthy and strong rather than waiting until there is a problem,” Mike explains.

Mike and other H21 board member attorneys have reviewed the legal documents of hundreds of congregations, serving over 50 churches in 2025 alone. When a church has their legal house in order, they can direct their focus on God’s mission by reaching their community for Christ.
